JNF to pay betterment levy on Jerusalem church lands

The Jewish Nationwide Fund (JNF) (Keren Kayemeth le-Israel) will probably be compelled along with the Greek orthodox Church to pay betterment levies of lots of of thousands and thousands of shekels on the Patriarchate’s land in Jerusalem. The imposition of the levies follows a choice on the matter by the Jerusalem District Planning and Constructing Appeals Committee. The quantity of the levies that the JNF should pay will probably be determined by an appraiser appointed by the committee. The choice will regulate the speed of participation of property tenants in betterment levies imposed by regulation on property homeowners.

The Greek Orthodox Patriarchate owns 520 dunams (130 acres) of land in Jerusalem, in among the costliest areas of town together with Talbieh, Rehavia and Nayot. Most of land is constructed on and consists of over 100 residences in addition to public establishments, places of work and motels. In 2016, the land was bought to a gaggle of traders referred to as Nayot, which in 2023 bought it on to Extell, managed by American Jewish actual property businessman Gary Barnett.

Through the years, the Jerusalem Native Planning and Building Committee permitted varied plans that enhanced the properties and elevated their worth. Since most of those plans have been when the proprietor of the land was the Greek Patriarchate, the Jerusalem Municipality submitted to the Patriarch a lot of cost calls for for plans, a few of which have been permitted so long as 30 years in the past.

One such plan was a fancy close to the Liberty Bell Backyard complicated, which rezoned land from an open public space to a particular business space. For this, the Patriarchate was requested to pay a betterment levy of NIS 357,000.

“An irregular state of affairs for the State of Israel”

The Patriarchate filed an enchantment in opposition to the levy by Advs. Benjamin Zalmanovich and Ariel Kamenkovich who claimed that as a result of the land was leased in 1951 by JNF-KKL for 99 years that the levy must be imposed on JNF-KKL and never the Patriarchate. The Jerusalem Native Planning and Building Appeals Committee, represented by Advs. Hila Sirota and Tamar Einy declare that the Patriarchate did profit from the land enchancment.

JNF-KKL, represented by Advs. Tamar Migdal and Avraham Yurkevich argued that if the levies are imposed, “It will be an absurd state of affairs that those that didn’t notice these lands can be required to pay – one thing that goes in opposition to the guiding rules of the betterment levy.

The Jerusalem Native Planning and Building Appeals Committee headed by Adv. Amit Afik wrote in response, “Within the enchantment, an irregular state of affairs arises for the State of Israel the place, as is thought, many of the land is owned by the state and it’s leased to non-public people. It’s this irregular state of affairs that creates the problem in finding the particular person accountable for the betterment levy.”

Nevertheless, the committee didn’t settle for the events’ (JNF-KKL and the Patriarchate) place, in accordance with which solely the opposite get together ought to pay the levy cost, and it appointed an advisory appraiser to find out what the development levy must be and the ratio between the worth of the lease rights on the land and the worth of the possession rights.
